DECLARATION OF RESTRICTIONS

THIS DECLARATION is made as of the  8th day of December, 2005, by AUSTIN MEADOWS, LLC, a Kansas limited liability company (“Developer”).

WITNESSETH:

WHEREAS, Developer has executed and filed with the Register of Deeds of Johnson County, Kansas a plat of the subdivision known as “Austin Meadows”, which plat includes the following described lots and tracts :

Lots 1 through 35, and Tracts A and B, AUSTIN MEADOWS
1st PLAT, a subdivision in the City of Olathe, Johnson County, Kansas.

WHEREAS, Developer, as the present owner and developer of the above-described property, desires to place certain restrictions on such lots to preserve and enhance the value, desirability and attractiveness of the development and improvements constructed thereon and to keep the use thereof consistent with the intent of the Developer, and all of said restrictions shall be for the use and benefit of Developer and its future grantees, successors and assigns;

NOW, THEREFORE, in consideration of the premises contained herein, Developer, for itself and for its successors and assigns, and for its future grantees, hereby agrees and declares that the above-described lots shal1 be, and they hereby are, restricted as to their use and otherwise in the manner hereinafter set forth.

HOMES ASSOCIATION DECLARATIONS & DECLARATION OF RESTRICTIONS
ADDITIONAL PHASE
(2ND and 3RD PLATS)

THIS DECLARATION is made  as of the 15th day of June, 2010, by Austin Meadows, L.L.C., a Kansas limited liability company (the “Developer”);

WITNESSETH:

WHEREAS, the Developer has executed and filed with the Office of the Register of Deeds of Johnson  County, Kansas (the “Recording Office”), an additional plat of the subdivision known.as “Austin Meadows”; and

WHEREAS; such plat adds the following lots to the subdivision (the “Additional Lots):

Lots 36 through 81, and Tract C, Austin Meadows: 2nd Plat, and
Lots 82 through 123, and Tracts D and E, Austin Meadows 3rd Plat,
a subdivision in the City of Olathe, Johnson County, Kansas.

WHEREAS, the Developer, as the owner of the Additional Lots, desires to subject the Additional Lots to the covenants, assessments, charges and other provisions contained in that certain Austin Meadows Homes Association Declaration, executed by the Developer and filed with the Recording Office in Boom 200512 at Pages 5662 and 5663 (the “Original Declaration”).

NOW, THEREFORE. in consideration of the premises, the Developer, for itself and for its successors and assigns, and for its future grantees, hereby agrees and declares that all of the other provision set forth in the Original Declaration. As contemplated in Article IX of the Original Declaration, this instrument shall have the effect of subjecting the Additional Lots to all of the provisions in the Original Declaration as though the Additional Lots had been originally described therein and subject to the provisions thereof.

Tracts C, Austin Meadows 2nd Plat and Tracts D and E, Austin Meadows 3rd Plat are “Common Areas”.

The landscaping allowance for all new homes in Austin Meadows is $400.00.

Section 01. Definitions
